In another escalation between the Aam Aadmi Party (AAP) government and the Lt Governor, Deputy Chief Minister Manish Sisodia on Friday accused LG V.K. Saxena was accused of interfering in the day-to-day functioning of the elected government and bypassing ministers and the House. calling it a “very worrying development”.
In a letter to the LG on Friday (seen by HT), Sisodia said: “…Your office has recently resorted to calling files from various departments through their respective secretaries. He made transactions with him, such as allowing the issuance of a statement, and completely bypassed the relevant ministers and Cabinet.”
Sisodia urged the LG to take “necessary corrective steps to avoid avoidable disputes”.
Officials at LG’s office did not respond to requests for comment.
Sisodia’s order is likely to intensify the rift between the LG and the AAP government. Earlier this year, the LG ordered several probes against the AAP government and its ministers, including the Central Bureau of Investigation’s probe into the implementation of the excise policy in which Sisodia is an accused. AAP denied all the allegations.
Recently, to facilitate the smooth rollout of 5G infrastructure in Delhi ahead of the G20 summit, LG has paved the way for the adoption and announcement of a sound Traffic Policy in the national capital. The approval of the policy was awaited by the Delhi government for two years. According to officials aware of the implementation, the LG gave its approval after chief secretary Naresh Kumar sent him the file.
“I am compelled to note that apart from being contrary to the established traditions and practices relating to the transaction of public business, it is inconsistent with the relevant provisions of the Constitution, which is hitherto contained in Article 239AA (Constitution). 1991 is the legal regime imposed by the Government of Delhi, the capital city of Delhi, and most recently by the five-judge Constitution Bench of the Supreme Court,” Sisodia added in his letter.
In an order dated July 4, 2018, the Constitution Bench of the Supreme Court, which was hearing a case related to the power dispute between the Delhi government and the Centre, directed it to act on the advice and assistance of the democratically elected representatives of Delhi. the government.
On January 10 next year, a five-judge bench headed by Chief Justice of India (CJI) Dhananjaya Y Chandrachud is expected to hear other cases related to the power tussle between the Center and the Delhi government over the governance of the Capital.
Referring to Article 239AA, Sisodia said that except for the three entities reserved under the law (public order, police and land), the elected government of Delhi holds all legislative and executive decision-making powers. remaining subjects (transferred subjects).
Sisodia said that notwithstanding Section 19(5) of the Transactions Rules, 1993 (which empowers the LG to require any department to submit documents relating to any proposal or matter), the LG does not have the power to make an independent decision. in transferred subjects. “Actually, the LG has to act according to the help and advice given to him by the Council of Ministers,” Sisodia wrote in the letter.
Sisodia urged the LG to “take timely and necessary remedial measures to avoid any controversy or embarrassment that may not be in the best interests of the people of Delhi. “I am sure that it is essential to work together.”
